There would be no legal framework or contract with a gift for a birthday etc.

The person giving you the gift doesn't say "I, Joe Bloggs, hereby gift you, Master Bloggs a Apple iPod to the value of £300 without recourse, lien or any restraint or condition" Do they?

In normal circumstances a gift is given as a gift and a legal change of ownership. But, of course, a parent might say this gift is on condition you pass your exams, or keep out of trouble etc.

A gift may be a transfer between spouses for tax avoidance. In this case there would have to be a formal contract.

Yes unless you are a child then it legally belongs to your parents. So if you gave a 5 year old a kitten the parents would have the right to take it away from them or even a 17 year old with a car since they have a right to raise children.

If a friend gives you an Ipad for a gift, legally they cannot take it back.

I just want to get this straight in my head, if someone gifts me something whether for my birthday, Christmas or any other occasion, is that gift then legally mine? Also if the person takes it back without my permission is it classed as theft?
